End User License Agreement

This End User License Agreement (“Agreement”) is between you (“User”) and Marimart (“Company,” “we,” “us,” or “our”) regarding your use of the Marimart mobile application (the “App”).
BY DOWNLOADING, INSTALLING, OR USING THIS APP, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT USE THE APP.
1. License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use in connection with accessing our medical marijuana dispensary services.
2. Eligibility and Age Requirements
You must be:
- At least 18 years of age
- A registered patient or caregiver in the Pennsylvania Medical Marijuana Program
- In possession of a valid Medical Marijuana ID Card issued by the Pennsylvania Department of Health
By using this App, you represent and warrant that you meet these requirements.
3. Account Registration
To use certain features, you must create an account and provide accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4. Permitted Uses
You may use the App to:
- Browse available medical marijuana products
- Place orders for pickup or delivery (where available)
- View your purchase history
- Receive notifications about promotions and product availability
- Access educational resources about medical marijuana
5. Prohibited Uses
You may NOT:
- Use the App if you are under 18 years of age
- Share your account with others
- Use the App for any illegal purpose
- Attempt to circumvent any security features
- Resell, distribute, or divert medical marijuana products
- Use the App in any manner that violates Pennsylvania medical marijuana laws
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright, trademark, or proprietary notices
6. Privacy and Data Collection
Your use of the App is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information and health data. We comply with HIPAA and Pennsylvania medical marijuana regulations regarding patient information.
The App may collect:

7. Orders and Transactions

- You must present valid identification and Medical Marijuana ID Card at pickup

9. Compliance with Law
You agree to comply with all applicable federal, state, and local laws, including Pennsylvania Act 16 (Medical Marijuana Act). Medical marijuana may not be transported across state lines.
10. Intellectual Property
The App and all content, features, and functionality are owned by the Company and protected by copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.
11. Updates and Modifications
We may:
- Update the App to add features, fix bugs, or improve performance
- Modify or discontinue the App at any time
- Change this Agreement by posting an updated version in the App
Continued use after changes constitutes acceptance of the modified Agreement.
12. Termination
We may suspend or terminate your access to the App at any time for:
- Violation of this Agreement
- Fraudulent activity
- Revocation of your Medical Marijuana ID Card
- Any reason at our sole discretion
Upon termination, you must cease using the App and delete it from your devices.
13. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APP.
15. Indemnification
You agree to indemnify and hold harmless the Company from any claims, damages, or expenses arising from your use of the App or violation of this Agreement.
16. Governing Law
This Agreement is governed by the laws of the Commonwealth of Pennsylvania without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Pennsylvania.
17. SEVERABILITY
Our website may contain links to third-party websites. We are not responsible for the privacy practices of these external sites.
18. ENTIRE AGREEMENT
This Agreement, together with our Privacy Policy, constitutes the entire agreement between you and the Company regarding the App.
